Еше одна ошибка - за то самое письмо обешали заплатить дофига а заплатили всего 3к (в несколько раз меньше).
Компания уверят что ето ошибка - и вот-вот перечислит остаток.

Там кстати у них еше одна фишка - зарплата платится с лагом в 2 или 3 недели.
Если умножить зарплату за ети недели на кол-во работников, да на 1% годовых (если по простому положить в банк) - то получится около 1млн в год.
Мелочь - а руководству наверняка приятно.

Парень пожаловался в министерство труда и вот ресультат-
компанию заставили доплатить компенсацию за отпуск.

Расчеты от него другим уволенным горемыкам:


From Company HR:
*Company provides full time permanent employees with vacation time. As per your original letter of offer, your vacation time is based on accruing 1.67 days per month of active service.*

It means till last day of service for client.
Company doesn't add following to vacation time calculation formula:
-2 weeks *on bench* (but we are company's employee and it's still regular work for the Company)
-termination period/pay

Example of calculation:
employee worked 6 month in current year (till Jul 1) on client account and got salary (during 6 months) = 40k (hour rate = around 40CAD). Then the employee was on 2 weeks bench and then laidoff. He worked in company 3 years.

company calculation - 1.67 days * 6 months * 8 hours * 40 = 3206.4 of vacation pay

Calculation by law -
2 weeks bench - 80 hours * 40 = 3200
3 weeks termination pay - 120 hours * 40 = 4800
(40000 salary + 3200 bench + 4800 termination ) * 8% = 3840 of vacation pay

Difference - 3840 - 3206 = 634CAD.

Employers do *mistakes*. But why I am not suprised that probability theory doesn't work and they do *mistakes* only from my pocket?

I called to Ministry of Labour - they told that I can claim in any case because company cannot break the law and pay less than minimal standards by law.

From Ontario labour law (they use 4% for regular 2 weeks vacation, we should use 8% because of 4 week vacation):

Sarah has worked for three and a half years. Now her job has been eliminated and her employment has been terminated. Sarah was not given any written notice of termination.

Sarah worked 40 hours a week every week and was paid $12.00 an hour. She also received four per cent vacation pay. Because she worked for more than three years but less than four years, she is entitled to three weeks' pay in lieu of notice.

Sarah's regular wages for a regular work week are calculated:

$12.00 an hour × 40 hours a week = $480.00 a week

Her termination pay is calculated:

$480.00 × 3 weeks = $1,440.00

Then her vacation pay on her termination pay is calculated:

4% of $1,440.00 = $57.60

Finally, her vacation pay is added to her termination pay:

$1,440.00 + $57.60 = $1,497.60

Result: Sarah is entitled to $1,497.60.
