[168] Inspector Raynor was of the view that she had the “right” (read: power) to hold anyone in a form of custody for as long as she wishes without advising that person that he or she is being detained and has a right to retain and instruct counsel. All four Inspectors shared the belief that search warrants are never necessary in a border-related context and that they need not therefore edify themselves of the search warrant provisions of their governing statutory authority.
[169] The result is that rather than a lowered expectation of privacy and a lower standard of the grounds with which to conduct a search as envisioned by the Supreme Court of Canada, the border would rather, be a Charter-free zone. It isn’t.
[170] The cumulative effect of violations of three Sections of the Canadian Charter of Rights and Freedoms coupled with the fallacious belief that prior judicial authorization is never required for the towing and dismantling of a vehicle, render the breaches very serious.
[171] In such circumstances, the Court cannot be seen to condone the existence of the continuing pattern of Constitutional violations.
[172] The evidence of the seized Cocaine must therefore be excluded.

Long story short... чувак перевозил 50 килограм нароты через границу, собака на границе собака унюхала кокаин... погранцы просверлили тачку без ордера и нашли наркоту... этим самым они нарушили права трафикера в том что типа нанесли дамадж его машине без ордера... теперь наркоту убрали из дела... и трафикер я так понял пойдет на свободу... мне интересно... они ему за моральный ущерб и за машину бабки заплатят, а то жалко парня.....
