NOTICE
To: All Persons or Entities in Canada who made a Hotel Reservation via www. Expedia .ca between July 28, 2008 and February 28, 2011 and were Assessed a Service Fee
NOTICE OF CERTIFICATION AS A CLASS ACTION
This Notice may affect your rights. Please read it carefully.
PURPOSE OF THIS NOTICE:
A class proceeding has been certified by the Ontario Court of Justice.
On February 1, 2013, Magill v. Expedia Inc., Court File No. 09-CV-381919 CP was certified as a class proceeding, and Tim Magill was appointed as the representative plaintiff (the "Plaintiff") on behalf of the Class (the "Class Action").
WHO IS THIS NOTICE FOR:
You are a member of the Class if you fit this description:
THE CLASS
Any person or entity in Canada who, between July 28, 2008 and February 28, 2011, booked a hotel reservation and/or any combination of automobile and flight reservations where a hotel reservation was a component of the reservation through www. Expedia .ca and were assessed a "Tax Recovery Charge" and a "Service Fee".
WHAT THE ACTION IS ABOUT:
The Class Action alleges that Expedia Inc. breached its contracts with customers by, among other things, charging a Service Fee that contained a profit element and by failing to disclose that profit to customers. The Class Action seeks a determination of whether Expedia Inc. had the contractual obligations alleged by the Class and, if so, if its conduct could amount to a breach of those obligations.
Expedia Inc. denies all the allegations made against it in the Action and denies that the members of the Class are entitled to any compensation. By certifying this Action as a class proceeding, the Court has not determined the merits of the Plaintiff's claims or Expedia, Inc.'s defences. The Plaintiff will be required to prove his allegations at a trial in order to entitle the members of the Class to then advance, based on the specific details of their transactions with Expedia, Inc., individual claims for breach of contract and for compensation for any breach that may be found to have occurred.
The Defendants:
The defendants in the action are Expedia, Inc. and Expedia Canada Corporation. However, the Court has granted certification of the Class Action only against Expedia, Inc. (the "Defendant"), and it is presently anticipated that the action will be dismissed against Expedia Canada Corporation.
HOW THIS CLASS ACTION AFFECTS YOU:
If you are a Class member, and you wish to participate in the Class Action, you do not need to do anything more at this stage. You are automatically included in the Class.
No Cost to You
You do not need to pay any legal fees out of your own pocket. A retainer agreement has been entered into between the Plaintiff and Juroviesky LLP ("Class Counsel") with respect to legal fees. The agreement provides that the law firm has been retained on a contingency fee basis, whereby it will only be paid its fees in the event of a successful result in the litigation or at a Court-approved settlement. The fees payable to Class Counsel for the Class will be paid out of any judgment and will not be paid directly by Class members. Any fee paid to the lawyers for the Class is subject to the Court's approval.
No Liability for Court Costs
You will not be responsible for the Defendant's legal costs if the action is unsuccessful. In the event that the costs are awarded against the Plaintiff, he will be solely responsible.
You will Be Bound by a Judgment or Settlement in the Action
Each Class member who does not opt out of the Class Action will be bound by the terms of any judgment or settlement approved by the Court.
HOW TO OPT OUT OF THE CLASS ACTION:
If you do not want to participate in the Action
If you DO NOT WANT TO PARTICIPATE in the Class Action, then you must say so in writing by delivering a letter to Class counsel, including your full name and address, on or before December 7, 2013 at 5:00 pm EST to the following address:
